Eventum Legal Police Investigations 15

Specialist defence for workplace, education and safeguarding allegations

Eventum Legal is a specialist criminal defence firm representing individuals accused of misusing power or breaching safeguarding boundaries. We defend managers, teachers, lecturers, tutors, supervisors, coaches, trustees, carers, clinicians and volunteers facing disciplinary, regulatory or criminal allegations across England and Wales.

You get early, clear advice, discreet handling, and rigorous case preparation from the first contact with HR, a Designated Safeguarding Lead, the police (including a police interview under caution), or a professional regulator.

We defend the accused; we do not prosecute. Our work includes issues involving positions of trust, sexual offences involving trust, workplace misconduct linked to authority, and referrals to the Disclosure and Barring Service.

If you have been told not to discuss the matter, speak to a defence solicitor first. Anything you say informally can be misquoted or misunderstood later.

Targeted defence for

  • alleged abuse of the position of trust, sexual offences involving a 16 or 17-year-old
  • workplace safeguarding breaches and boundary concerns
  • complaints about misusing power in recruitment, grading, discipline or benefits
  • DBS referrals, provisional listings and barring service representations

What does abuse of power mean in these cases

In UK workplace and education contexts, abuse of power generally means exploiting a role, authority or responsibility to gain an unfair advantage or cause harm. The meaning of abuse of power is always fact-specific. In schools, colleges and youth settings, it often centres on boundaries with young people, direct contact and professional conduct.

In workplaces, it may involve coercion, unfair treatment, favouritism or pressuring a junior colleague.

A single message, lift home, reference, small gift or social meet can be misread. We define abuse of power in the context of your job description, lines of authority, supervision, safeguarding training, policies and the actual evidence.

An allegation is not proof. Where sexual allegations are raised, we assess consent, capacity and the statutory framework that may turn contact into a criminal offence because of a position of trust.

We will help you answer common queries such as how to define abuse of power in your setting and what a regulator or court would consider a breach.

Position of trust and trust sexual offences

If you work with children, certain roles carry a higher duty. The Sexual Offences Act 2003, amended in June 2022, expanded the scope of those who may be in a position of trust, including regular coaching or teaching roles in sports and religious settings.

For many roles with direct contact, the legal age for sexual activity is effectively 18, where a position of trust exists, even though the general age of consent is 16. The law is designed to protect children and young people from exploitation by trusted adults.

The prosecution must prove that a statutory position of trust existed and that you engaged in sexual activity or caused or incited a young person to engage in sexual activity. These trust offences are either way offences.

They can be heard in the magistrates’ court or the Crown Court. The maximum sentence is five years’ custody for position of trust offences, with sentencing depending on age, any sexual act alleged, aggravating factors and harm.

We test whether your role meets the legal definition, whether you had sole charge or meaningful authority, and whether the complainant’s account is reliable. We also consider any limited statutory exceptions.

Campaigns to close perceived loopholes prompted the 2022 changes, which cover a wider range of sports settings and faith activities. Serious penetration allegations, such as assault by penetration, are treated with particular gravity.

School Police Investigation

If your school or employer raises concerns

  • Do not provide a statement or timeline before speaking to a defence solicitor.
  • Preserve messages, emails, timetables, safeguarding logs, device data and any CCTV or access records.
  • Identify witnesses who can speak to conduct, training, direct contact levels and supervision.
  • Keep copies of your contract, job description, codes of conduct and risk assessments.
  • Note any immediate restrictions placed on you and their stated reasons.

Internal processes often run in parallel with criminal enquiries. We prepare you for HR, safeguarding, and regulatory interviews, advise on barring service risk, and engage with investigators to ensure a fair process and full context.

How we build your defence

We map your duties, chain of command, and the real power you held, then measure that against policies, supervision, ratios, and whether you held current positions with authority over a child or colleague.

We examine direct contact and any evidence of physical contact, as well as digital records, training logs, and incident reports.

Where sexual abuse or boundary crossing is alleged, we analyse consent, communication, capacity and credibility. Where financial allegations arise, we advise on whether dishonestly abusing a position may be suggested under the Fraud Act 2006, and coordinate with specialist counsel where needed.

We instruct appropriate experts, for example, in safeguarding practice, workplace behaviour or data forensics. We challenge aggravating factors that lack evidence and present genuine mitigation where appropriate.

We address non-exhaustive, list-style boundary allegations, favouring balanced evidence over assumptions. Our goal is to shape the investigation at the pre-charge stage, narrow issues, and secure the most proportionate result.

Courts, sentencing and likely outcomes

Some matters remain internal. Others proceed to the criminal courts. Trust offences linked to sexual activity with a young person can be charged and, depending on seriousness, may be tried in the Crown Court. Less serious matters, or process offences, may remain in the magistrates’ court.

Sentencing considers the nature of any sexual act, planning, breach of policy, age and harm. Outcomes range from a community order to years’ custody, subject to the guidelines for the offence, with the statutory maximum sentence for position of trust sexual offences at five years.

Ancillary orders can include Sexual Harm Prevention Orders and notification requirements. A conviction may also affect employment and professional registration.

We work to avoid charges where possible, seek alternatives to charges, and press for fair, proportionate sentencing if a case proceeds. If you are due to appear, our guide to going to court explains what to expect.

Professional, safeguarding and career consequences

Suspension, loss of job offers and safeguarding alerts can begin within days. Internal findings are often shared with the Disclosure and Barring Service and sector regulators, including those overseeing teachers, social workers, doctors and nurses.

The DBS scheme aims to keep unsuitable people from working with children or vulnerable adults, but interim listings can be disproportionate if the background is not properly understood.

We act to contain reputational risk, manage communications and challenge one-sided referrals. We submit robust representations to the barring service, addressing risk with evidence and context.

Where an investigation highlights a physical skill coaching role, religious settings, or concerns in wider society, we ensure the legal tests are applied in the same way as in any other educational establishment or residential care home.

Abuse Of Power Defence FAQs

What should I do if HR or a Designated Safeguarding Lead contacts me about an allegation?

Do not provide a written statement or timeline before speaking to a defence solicitor. Preserve messages, schedules and policies, and ask for the scope of the concern. We can advise you on both the internal process and any linked criminal enquiry, and attend any related police interview under caution.

The general age of consent is 16. Where a statutory position of trust exists, the law treats sexual activity as unlawful until the young person is 18. The Sexual Offences Act 2003 was amended in June 2022 to expand the scope of positions of trust to include regular coaching or teaching roles in sports and religious settings. Limited exceptions can apply where a lawful relationship predated the role.

No. Employers and safeguarding bodies may refer cases to the Disclosure and Barring Service. Provisional listing can occur, but it is not automatic and can be challenged. We prepare detailed representations to the DBS using evidence and context to reduce the risk of disproportionate interim decisions.

Yes. We represent clients at the police station, prepare your interview strategy and protect your rights. Early advice helps avoid misunderstandings and keeps the focus on verified evidence. If you have been asked to attend, contact us immediately for confidential guidance.

Each case turns on its facts. Our approach is to shape the investigation early, challenge weak or unreliable evidence and seek proportionate results. That may mean no further action, alternatives to charge or, if a case proceeds, arguing firmly for the correct venue and a fair sentence based on the guidelines.
